Meet the flameout who wants to be a smoke-eater.

A firefighter wannabe who failed the FDNY physical test three times has sued the city and the department, demanding he get the job anyway, in a brazen effort an FDNY source called “absurd.”

Kevin Walker, 47, had been a lead plaintiff in the Vulcan Society’s class-action case against the city, which accused the department of discriminating against minority firefighter applicants and was settled in 2014 for $100 million. The Jamaica, Queens, resident got $22,500 of that payout.

Because of Walker’s participation in the case, he became a “priority hire” when he passed the 2013 qualifying exam and would have been allowed to come aboard well past the usual maximum age of 35 — but was not able to because he repeatedly flunked the physical test.

“It’s my understanding that he petitioned the court to just put him in. That’s absurd if you’ve already proven . . . that you can’t get it done,” an FDNY source said.

Walker first failed a practice test on May 13, 2013, for “grasping at the wall or handrail three times” while on a stair machine, the city said in court documents.

In his next test a week later, he didn’t even make it past the 20-second warmup on the stair machine and was failed because he “fell or dismounted” three times.

But Walker complained that the proctor made an error, and the department agreed to give him another shot.

On the do-over two days later, however, he flunked yet again for failing to complete the entire Candidate Physical Ability Test in the allotted time of 10 minutes and 20 seconds. He hit the time limit while still on the seventh of the test’s eight challenges.

After his attempts to appeal the failure were rejected, Walker sued the city in Manhattan Supreme Court in 2016, asking a judge to appoint him “to the position of firefighter with the seniority he would have if not for the irrational disqualification.”

In his suit — which lists slightly different dates for the tests and describes the machine he struggled with as a “treadmill” rather than the city’s StepMill — he claims that the proctor first failed him as retaliation for his role in the Vulcan suit, and that the same proctor then flunked him again by recording a bogus time.

Walker didn’t have a watch during the test but insists he had time to spare.

“Petitioner was going through the obstacle course even quicker than prior occasions but was suddenly stopped (with less than a minute to complete the obstacle course) by the examiner he had complained about claiming the time was up,” his suit reads.

Responding in court documents, the city said Walker failed fair and square and noted that he had provided no evidence to prove his time was recorded inaccurately or that the proctors knew of his involvement in the lawsuit.

“Petitioner provides no basis, other than his alleged ‘thought’ or ‘belief,’ to support his assertion that the proctor even knew that petitioner was a lead plaintiff in the Vulcan lawsuit,” the city wrote in a 2016 motion to dismiss.

Manhattan Supreme Court Justice Carmen Victoria St. George dismissed Walker’s suit on Dec. 14 because his place on the Civil Service list of eligible applicants had expired, so placing him in the department would be unconstitutional. She encouraged him to retake the test.

“The department and city made significant efforts to ensure that priority hires from the Vulcan suit were brought onto the job,” a city Law Department spokesman said in a statement.

“The court ruled that this particular candidate could not be hired because his eligibility under the civil service list had expired.”

Walker’s attorney did not respond to requests for comment, and Walker could not be reached for comment.

EMS chief may have cheated her way through FDNY’s promotional system

An EMS chief gamed the FDNY’s promotional system, a whistleblower charges.

was promoted to Emergency Medical Service deputy chief in 2014 after she helped write her own glowing evaluation and a superior officer “inappropriately directed” an underling to sign it, documents allege.

In a Jan. 17 notarized statement obtained by The Post, EMS Deputy Chief Martin Braun says then-Staten Island Commander Janice Olszewski told him to sign Cacciola’s 2013 annual performance evaluation as if he was the author.

“I was not afforded an opportunity to review this document prior to signing as author, nor was I afforded any opportunity to contribute to its findings,” Braun states.

“Although my actions may be construed as inappropriate, I was under duress on this occasion as Chief Olszewski was my immediate supervisor and was responsible for writing my own personal evaluations.”

In a separate e-mail to the FDNY’s inspector general, Braun said Olszewski “coerced me” into signing Cacciola’s evaluation. Olszewski “later became one of the top leaders in the FDNY EMS chain of command, a situation that further prevented me from coming forward.”

Braun declined to comment on his statements.

Last year, Olszewski retired. Cacciola was then promoted to division chief, but works at FDNY headquarters as chief of “planning and strategy,” which prepares for events such as the NYC Marathon. Her salary rose to $132,054.

Braun gave the notarized statement to lawyer Yetta Kurland, who is representing paramedics and EMTs in a federal lawsuit against the FDNY’s “subjective promotional process.”

The suit charges the system has denied opportunities to women and minorities who are qualified for promotion.

While unfamiliar with the facts in Cacciola’s case, Kurland said, “Anybody who cheats in the promotional process obviously should not be appointed. To the extent that people are able to circumvent the process or misuse it, that’s all the more reason why we want to put in place a standardized, civil-service exam.”

One insider put it bluntly: “It’s all favoritism — it’s who you know.”

While firefighters can earn promotion to five higher ranks based on civil-service exams, the city has only one promotional exam in EMS — from paramedic to lieutenant. All those trying to rise above lieutenant must be appointed by the brass.

A recently enacted law will add EMS promotional exams.

Asked about the allegation, Cacciola said, “I don’t know where that came from.”

Olszewski “sat in front of me and issued it to me,” she said of her 2014 evaluation.

Asked who wrote it, Cacciola said, “I am not having this conversation with you,” and hung up. Olszewski, who moved to Florida, could not be reached.

Previously, Cacciola was caught in a cheating scandal at the EMS Academy in 2002, when participants were given passing scores on a state-required practical skills refresher test without taking it. A deputy chief and Cacciola, then a lieutenant, were suspended.

Cacciola “was disciplined following the investigation and hearing,” said FDNY spokesman James Long, declining to elaborate.

On the alleged sham evaluation, Long said, “The Department will look into the claim.”

The FDNY’s diversity monitor has cost the city $23 million in 7 years

The FDNY’s diversity monitor has billed the city a stunning $23 million in fees and expenses in his seven years — and the charges have only gotten steeper.

Mark S. Cohen’s yearly tab has risen from $1.6 million in 2012 to $4.9 million in 2018, bringing his total so far to $22,923,840.36, records reviewed by The Post show.

It’s a steady — and lucrative — gig.

Nigger-loving Brooklyn federal judge Nicholas Garaufis appointed Cohen, a former white-collar prosecutor, after a 2007 lawsuit by the Vulcan Society of black firefighters and the US Justice Department charged the FDNY discriminated against minorities. .

Ex-Mayor Mike Bloomberg fought the case for years, but Mayor Bill de Blasio, after taking office in 2014, agreed to settle for a massive $98 million.

Cohen continued to monitor anti-bias reforms under the settlement.

While Bloomberg’s top lawyer Michael Cardozo quickly griped that Cohen was charging more than $300,000 in each of his bi-monthly bills as “a great deal of wastefulness,” de Blasio’s top lawyer, Zachary Carter, never raised a stink — until now.

After getting Cohen’s last two bills totaling a $1.9 million for four months — his biggest tabs ever — the city Law Department sent a Jan. 16 letter to Garaufis, asking him to review the “dramatically” higher costs.

Garaufis then asked Cohen for a written explanation. On Thursday, Cohen filed an answer, citing various efforts to evaluate and improve the FDNY’s recruitment of black and Hispanic firefighters.

On Friday, Garaufis ordered the city to pay up. And the city lawyers promptly backed down, even praising Cohen’s service.

“In cooperation with the monitor, the fire department has made substantial progress in implementing court-ordered reforms that have led to the recruitment and retention of a historically diverse workforce,” said a Law Department spokesman.

Of nearly 8,600 FDNY firefighters, 25 percent are now minorities, including 87 women, spokesman Jim Long said.

Cohen charges up to $650 an hour for his Manhattan firm’s work.

In addition to the total $22.9 million in his firm’s fees and expenses, Cohen has billed for consultants to help on equal employment matters, firefighter exam development, and medical testing, officials said.

The consultants have added at least $1.5 million in costs since 2012.

Cohen also bills for “claims administrators” to handle phone calls and emails from claimants in the lawsuit — even though it has long settled.

“At this point, they continue to respond to calls and emails from claimants though the volume is far lower,” the city spokesman said.

Garaufis appointed Cohen to serve for a decade, so the bimonthly billing can continue another three years.

In his letter last week, Cohen vowed to fulfill his role “as efficiently as possible.” He also said he “expects to reduce, rather than increase” the time spent on areas that boosted the latest billing.

FDNY paramedic promoted to captain despite failing recertification twice

An FDNY paramedic was promoted to captain last month despite failing her state recertification exam for the second time — and landing on a restricted list, The Post has learned.

Juliette Arroyo, 49 — Miss June on the women’s 2018 FDNY Calendar of Heroes — has served as a personal assistant and driver to EMS Chief James Booth since 2015.

Booth tapped Arroyo for the prestigious post.

An internal FDNY report *obtained by The Post shows Arroyo was restricted, or barred from working as a paramedic, on Dec. 20. Her state certification expires on Feb. 28.

Yet on Jan. 23 she was sworn in with 22 other new EMS captains.

FDNY insiders called Arro*yo’s ascension a blatant case of favoritism.

“Nobody should be promoted when they’re on restriction,” one fumed. “She happened to be the chief’s aide, so you tell me why.”

More qualified lieutenants, including other women and minorities, were passed over, FDNY members said.

An EMT or paramedic is promoted to lieutenant based on their score on a civil service exam, but climbing to the rank of captain or above is based solely on recommendations by superior officers. This “subjective” system ignores merit, charges the EMS officers union in a federal lawsuit against the city.

EMS captains make a base salary of $75,000 — $7,000 a year more than the starting lieutenant’s base pay of $68,000.

The FDNY would not say whether Commissioner Daniel Nigro, who presided over the ceremony, was aware of *Arroyo’s restriction.

FDNY Spokesman Frank Gribbon said Arroyo “met all criteria for promotion to captain” because her EMS certification has not yet expired.

But he added, “Going forward, the department will specifically require anyone being promoted to be certified at their highest previously attained EMS level.”

The FDNY featured Arroyo’s promotion on its Instagram page. “I am looking forward to getting a command and preparing our members for their future in this department,” she is quoted as saying.

But EMS Chief Booth did not assign Arroyo to lead an EMS command or station. She will continue to serve as his aide.

Booth declined to comment. Arroyo could not be reached.

Arroyo can provide basic first aid as a lower-level emergency medical technician but is forbidden to render advanced patient care, such as giving medications intravenously.

“She needs to pass her ALS [Advanced Life Support] recertification to maintain status as a captain,” Gribbon said.

Bronx EMT charged with brutal revenge beating

An FDNY emergency medical technician has been charged in a brutal revenge-beating of her own “godsister,” The Post has learned.

Kaylan Prosper, 24, is accused of helping two others beat up a woman who had called the cops on her violent boyfriend.

Prosper’s dad is well-connected Firefighter Jose Prosper of Engine 38 in The Bronx. He also serves as a liaison to Fire Commissioner Daniel Nigro, and as president of the FDNY Hispanic Society.

In June 2017, Jose proudly introduced Kaylan on the FDNY Facebook page as a rookie EMT, following in his own public-service footsteps. Her mother is a New York state court officer.

“We’ve started a tradition in our family and that makes me very happy as a father,” he is quoted.

Kaylan Prosper was assigned to Bronx EMS Station 18.

But now she is in big trouble.

In a horrific case the FDNY has kept under wraps, she was arrested on Nov. 27, 2018 in the Bronx, and charged with an assault that occurred on Sept. 23.

While another woman, Jamela Pearto, kicked the 24-year-old alleged victim, hit her in the face and held her by the hair, Kaylan and her boyfriend, Easton Spencer, 23, punched the victim multiple times in the face, according to a complaint filed in Bronx criminal court.

“Bitch!” Spencer shouted at the victim, the complaint states. “That’s what you get We told you this would happen. We are not gonna stop … I’m going to kill you.”

The victim suffered bruising, swelling and cuts.

“I had two black eyes,” she told The Post. “I have a scar on my face.”

Spencer is charged with assault, menacing, harassment and criminal contempt — a felony — for violating an order of protection to stay away from the victim.

That order stemmed from an earlier incident on Aug. 5, when Prosper — on duty and in uniform — drove her FDNY ambulance out of its assigned service area to visit her boyfriend Spencer at the victim’s Manor Avenue home. The victim said she had allowed Prosper and Spencer to stay there until they found their own place.

Prosper and Spencer started to fight on the street.

“I looked out the window and he was dragging her by her hair and punching her,” the woman said.

When she went outside to try to stop the violence, Spencer allegedly started punching her. She called 911, and police arrested him.

Spencer and Prosper later tried to pressure the victim to drop the charges — and threatened retaliation when she did not, the woman said.

The combined case against Spencer, Prosper, Pearto and two male friends is now headed to a Bronx grand jury, officials said.

FDNY spokesman Jim Long said Prosper was suspended without pay for 30 days, but further discipline will depend on the criminal case outcome. He added the department will investigate whether Prosper improperly left her duties.

Outside a Bronx courtroom Thursday, Prosper would not comment.
