Man arrested in vicious New Year’s Day assault of Toronto lawyer at Bathurst and Queen
Mon., Feb. 4, 2019

Police have arrested one man and are seeking another suspect following a vicious New Year’s Day assault in downtown Toronto that put a lawyer in a coma.

At roughly 12:30 a.m. on Jan. 1, David Shellnutt and a woman were walking near Queen St. W. and Bathurst St. when a group of men in a passing car allegedly made a “lewd remark” at the female, police said.

Shellnutt threw a bag of garbage at the car in response and two men got out of the vehicle to confront him. Surveillance video showed one of the suspects punching Shellnutt, knocking him unconscious. The other suspect then punched Shellnutt while he was down on the ground.

The two men then fled in the vehicle. Shellnutt was initially in a coma, and in critical condition but is recovering and walking and talking, police told reporters at a news conference on Jan. 17.

Keron Alvarez, 35, of Toronto, was arrested Friday and charged with aggravated assault.

Police are still seeking a second suspect. He is described as 25-35 years old, six-foot with a slim build, corn rows and a beard. He was wearing a black hooded sweatshirt, black pants and black running shoes at the time of the incident.

“David was a champion of the black social justice movement here in Toronto and his dedication to his social justice commitments are what made him a passionate, strong and powerful advocate,” he said. “All I can say right now is that we are deeply saddened by what’s happened. We are deeply saddened by the state he is in right now.”
