US marshals, armed man trade gunfire in Queens

Gunshots were fired at US Marshals and NYPD cops when they used a battering ram to make their way into the home of a suspected drug smuggler in Queens, authorities said.

Oswald Lewis was armed with several guns and wearing a bullet proof vest when the Marshals broke down the rear door of his Springfield Gardens home on 175th Street around 11 p.m. Tuesday. He then unleashed a hail of bullets at the specially trained squad.

“The guy inside just started busting shots at the cops. The cops ran for their lives,” said witness Aberdean Lysaith, 31. I swear I’ve never seen cops run like that and they had their guns drawn.”

Police sources said Lewis, who was wanted for cocaine trafficking, fired anywhere between 15 to 20 shots from inside the house before heading into the backyard.

There, he came face-to-face with NYPD cops who provided backup for the Marshals.

The fugitive fled back into the house before he was shot in the hand, after which he tossed his weapon out the door and surrendered.

“I’m shot, I’m shot. Don’t shoot. Don’t shoot,” Lewis whimpered to cops.

The team of Marshals tackled the man and cuffed him as he walked out of the house and then loaded him into an ambulance.

“They dragged him out,” said Lysaith. “One of the cops stepped on his head. They disarmed him, took his bullet proof vest off and put him on the stretcher. He was bleeding like crazy.”

Lewis was wanted on drug charges in three states — North Carolina, Virginia and Maryland — and is suspected of stabbing a man in Brooklyn earlier this year, law enforcement sources said.

In recent days, investigators obtained information that he was going back and forth between Brooklyn and Queens, trafficking cocaine in the East Flatbush area.

“He was on the run for a long time — since the 90s,” said a police source.

An accused drug smuggler whined in Brooklyn federal court Wednesday that his left arm hurts where US Marshals shot him after he opened fire on them during his arrest in Queens last week.

“The excruciating pain of the defendant brings him to tears, we fear his arm is getting worse,” said the defense attorney for Oswald Lewis, who wants his client to get Percocet pills every four hours instead of just twice a day.

Judge James Orenstein refused to play doctor and instead ordered Lewis to be reevaluated by medical staff.

“I’m not a doctor and neither are you,” the judge told defense attorney Christopher Booth.

Lewis, 44, was armed with a .40-caliber semi-automatic handgun, wore a bulletproof vest, and claimed to have a hostage when marshals used a battering ram on his front door on Aug. 26, court papers state.

He has been a fugitive for nearly two decades on charges stemming from a 1991 warrant and was wanted in three states on drug charges.

Police discovered human remains buried in a Brooklyn back yard after being tipped off by an alleged drug smuggler who was arrested in August following a wild shootout with US marshals, sources said.

Authorities excavated the back yard in Crown Heights Thursday afternoon after they received info from alleged cocaine trafficker Oswald Lewis that a body was buried there, according to law-enforcement sources.

The skeletal remains were found wrapped in plastic and were sent to the Medical Examiner’s Office for testing, the sources said. It was not clear if Lewis is a suspect in the killing. The residents of the home were questioned and released.

Lewis, 44, was armed and wearing a bulletproof vest when marshals broke down his door in Queens on Aug. 26. He unleashed a barrage of bullets before he was shot and surrendered.

A Queens con acting as his own lawyer was found not guilty of attempted murder Thursday in connection with a shootout with US Marshals.

Oswald Lewis, 45, convinced jurors that he didn’t fire the first shot at a crew of eight officers who came to execute an old arrest warrant at his Springfield Gardens home in August 2014.

He still faces 10 years to life when he’s sentenced on June 23, after being convicted of weapons and assault raps.

Prosecutors argued that Lewis initially opened fire on the squad from a bedroom, nearly striking a female officer in the head, and that the marshals returned fire, hitting him in the wrist.

Repeatedly calling the marshals “liars,” Lewis said he didn’t know the intruders were law enforcement and only fired his weapon after being shot at first.

“They know how to lie,” Lewis said during his closing statement Thursday. “They know how to talk. But this isn’t a CSI movie — this is real life.”

Stone-faced marshals watched his summation from inside the court well.

“It was the most surreal thing to watch a perpetrator who tried to kill you wear a suit and tie and speak softly, eloquently, and passively in a courtroom,” one of them said afterwards.
