Neighbors demand end to killing of chickens in Jewish ritual

Feathers flew in Manhattan court Tuesday as a group of residents demanded that a judge stop the “unsanitary’’ Jewish religious ritual of slaughtering chickens on the sidewalk during Yom Kippur.

“This is an epidemic waiting to happen. We just had this Legionnaire’s break out in The Bronx where 12 people died,” said Nora Marino, the lawyer for the Alliance to End Chickens as Kaporos, whose members carried photos of bloodied dead chickens into the courtroom.

The practice violates 15 different laws included in city and state health and agriculture regulations, Marino said.

Some Jewish people believe that the September ritual Kaporos absolves one’s sins with the sacrifice of a chicken.

Rabbi Shea Hecht, a human rights commissioner under former Mayor Rudolph Giuliani, was in court to call the lawsuit “an attack on our religious freedom.”

But Marino’s 19 clients — from the Borough Park and Crown Heights neighborhoods in Brooklyn where the ritual takes place — say the resulting “stench, litter, blood, feces and feathers” pollute city streets.

“I am an elderly woman, and this scene horrifies me each year,” said 93-year-old Borough Park resident Frances Emeric.

“I saw live chickens with dead chickens and chickens screaming while the people participating in the ritual were holding the birds by their wings,” Emeric said, describing last year’s Kaporos.

David Jaroslawicz, who represents Hecht, derided the protesting residents as a bunch of “vegetarians” and “vegans” who whipped up “make-believe hysteria where it doesn’t exist.”

He noted that during the past 40 years that the ritual has taken place, not one person has fallen ill from the slaughtered chickens.

Manhattan Supreme Court Justice Debra James said she’ll rule Sept. 10, about a week before the three-day slaughter festivities start.

Jewish chicken-slaughter ritual gets OK from judge

All’s fair when it comes to slaughtering fowl on the streets of Brooklyn, a judge ruled Monday, clearing the way for thousands of chickens to be killed next week in a 2,000-year-old ritual.

Manhattan Supreme Court Justice Debra James ruled that the Orthodox practice of Kaporos, during which chickens are slaughtered before the high holy day of Yom Kippur to atone for sins, can proceed, knocking down a challenge by a Brooklyn animal-rights group.

The ruling came on Rosh Hashanah, the Jewish New Year, which starts the 10-day holy period leading up to Yom Kippur.

“No one has the right to change our religion, and this ruling proves we can’t be touched,” cheered Yossi Ibrahim, 27, in the Hasidic enclave of Crown Heights.

A group of residents calling themselves The Alliance to End Chickens as Kaporos had sued the city, the NYPD and local Jewish leaders in state Supreme Court, arguing that the ritual was inhumane and unsanitary.

According to court documents, “The Kaporos ritual . . . involves the practitioners’ grasping of live chickens by their wings and swinging them above their heads three times and reciting prayers.

“The purpose of this act is to transfer the practitioner’s sins to the birds. After swinging the bird, the adherents slit the chickens’ throats with a sharp knife. The meat is then donated to the poor,” papers state.

The alliance argued that the ritual had grown into a “carnival-like and chaotic public nuisance,” as more and more participants inhumanely kill the birds and then leave their bacteria-teeming carcasses in the street.

Critics also scoffed at the notion that the dead birds were distributed to the poor afterward.

But the defense argued that the case was about religious freedom — and allowing participants to carry on a ritual that “has been practiced for at least 2,000 years.’’

Justice Debra James sidestepped the religious argument, saying there just wasn’t enough proof that the ritual was a public nuisance.

Meanwhile, Nora Constance Marino, the activists’ lawyer, said she was “devastated.”

“I’m beside myself right now,’’ she said. “I’m devastated because this is an egregious event with respect to public-health issues, quality-of-life issues and animal-cruelty issues.

“To be forced to endure opening up your front door annually to a mass animal slaughter is just dumbfounding.”

A Hasidic man in Brooklyn flips off an animal-rights activist with one hand — while preparing to slaughter a chicken with the other.

The bizarre scene occurred three days after a group of Brooklyn residents lost a court battle to prevent the ritual slaughtering of chickens before the Jewish holiday Yom Kippur.

Geralyn Shukwit took the photograph on 50th Street in Borough Park on Thursday.

Dawson and other members of the nonprofit Alliance to End Chickens as Kaporos are planning protests for Sunday and Monday nights when the bulk of the 50,000 birds will be killed.

The Orthodox practice of *Kaporos involves transferring one’s sins to the bird by swinging it over the practitioner’s head three times and then slitting its throat.

The alliance’s attorney, Nora Constance Marino, called the event “disgusting” and is considering appealing Manhattan Supreme Court Justice Debra James’ ruling allowing the ritual.

Activists want city to axe chicken-slaughter ritual

A group of animal-rights activists want the city to stop the slaughter of 50,000 chickens on the streets of Brooklyn in the days leading up to Yom Kippur.

“This is a huge public health threat, a toxic soup,” said Nora Marino, a lawyer who is suing the city to stop the ritual practiced by some ultra-Orthodox Jews. “This is how epidemics start. You can’t just have a make-shift slaughterhouse in the middle of a residential neighborhood.”

“Kaporos” is a 2,000-year-old ritual performed during the 10 days between the celebration of Rosh Hashanah, the Jewish new year, and Yom Kippur, the day of atonement which begins Tuesday evening. The penitents swing the live chickens over their heads, symbolically transferring their sins to the birds and then slicing their throats.

Last week, Marino and 60 members of a group called the Alliance to End Chickens as Kaporos held a rally outside City Hall to raise awareness of the health risks.

“Dead chickens, half dead chickens, chicken blood, chicken feathers, defecation, toxins and garbage consume the public streets,” said Karen Davis, a founder of the protest group, in a message on the Alliance’s web site.

They also called the ritual “barbaric.”

Last year, the group unsuccessfully sued a group of Hasidic rabbis and synagogues, along with New York City for what it said was its failure to enforce sanitation, health code and other regulations.

“It’s a First Amendment issue,” said David Jaroslawicz, a lawyer who represented the Hasidic defendants in the suit. “Everyone has freedom of religion unless they are doing something to hurt others.”

Jaroslawicz told The Post that the ultra Orthodox Jews who participate in the ritual clean up after the slaughter, and distribute the dead chickens to poor members of their community to cook for the holidays.

“The people who brought this lawsuit are avowed vegetarians,” he said.

Last week, the Alliance withdrew its complaint against the Hasidic community and in its new court filings is blaming the city for allowing the kaporos practice to continue.

The city did not return The Post’s request for comment.
