Lawyer for Brooklyn judge accused of obstructing justice implicated in scheme

The lawyer retained by a Brooklyn supreme civil court judge accused of obstructing an investigation into multi-million dollar fraud may also be implicated in the case, according to prosecutors.

Assistant U.S. Attorney Daniel Richenthal said Monday that attorney Roger Archibald represented Sylvia Ash during the government’s investigation into fraud at Municipal Credit Union, and signed off on papers that the government claims contain false statements from Ash.

“Mr. Archibald appears implicated in the conduct,” Richenthal told Manhattan federal court judge Lewis Kaplan. “He was either a witness or an active participant in overt acts.”

Ash, who was suspended with pay following her arrest last month, is accused of helping cover up crimes committed by MCU’s former CEO Kam Wong. Wong previously pleaded guilty to engaging in a multi-million embezzlement.

Prosecutors claim Ash deleted text messages and also scrubbed the contents of iPhone, therefore destroying evidence.

Archibald said Monday his client had spoken to another attorney about the possible conflict of interest, but still wished to retain him.

No decisions regarding possible conflict were made during Ash’s brief court appearance, where she pleaded “not guilty” to a new indictment charging three counts of obstruction of justice.

Archibald declined to comment on the government’s allegations against him.

A tentative trial date was set for May 18. Ash faces up to 20 years behind bars if convicted.
