Former OC deputy accused of stealing suspect’s debit card pleads guilty to misdemeanor

A former Orange County sheriff’s deputy who took a shoplifting suspect’s debit card pleaded guilty Friday to a misdemeanor charge of filing a false police report.

Angelina Cortez, who had reported the card was booked into evidence when she actually had given it to her son, took the plea deal after Orange County Superior Court Judge Larry Yellin reduced the charge from a felony, over the objection of prosecutors.

Yellin sentenced Cortez, 41, to 120 hours community service and one-year informal probation. She received no jail time. Cortez could have faced a maximum sentence of three years in jail if convicted of a felony.

Cortez and her training officer responded Nov. 19, 2018, to a report of a man stealing wine and batteries from a 7-Eleven store in San Clemente. Cortez took the suspect’s debit card and reported that she had booked it into evidence when she had not.

Cortez was placed on paid leave, collecting more than $45,000 to stay home while her case was investigated. She has since left the department, but it was unclear if she was terminated or resigned.

District Attorney Todd Spitzer said there should not be a separate law for police officers.
“The public must be able to trust that law enforcement officers will carry out their duties lawfully,” Spitzer said. “When the law is broken by the very people who are entrusted to enforce it, the integrity of the entire criminal justice system is compromised. We will not allow the rule of law to be abused by someone in a position of power who chooses to prey on the vulnerable.”
