Babysitter Gets Punched, Dies After Apparently Defending Kids

Police say a man with spina bifida died when he was punched at a Pennsylvania playground by another man who believed the victim had been threatening children with a stick.

York police say the dead man, 25-year-old Oscar Cherry III, was merely defending some little girls he was babysitting Monday after another group of children threw rocks and sticks at him and called him names.

When Cherry picked up the stick to defend himself, two children ran home and got their cousin, 18-year-old Kwamiere Durham.

Police say Durham confronted Cherry and when Cherry didn't respond, Durham punched him in the face. Cherry fell and hit his head. He died Tuesday.

Court records don't list an attorney for Durham who's jailed on homicide and assault charges.

Spina bifida is a congenital defect of the spine.

York man dies after punch to the head on city playground
YORK, Pa. – At about 7:39 p.m. Monday night, York City Police responded to the area of Girard Park for a shooting. Upon arrival, it was determined that a shooting did not occur, but officers did find Oscar Cherry III, 25, York, at the basketball court, unconscious and bleeding from the head. Officers administered CPR and Cherry was revived in the ambulance, then transported to York Hospital. Today Cherry, was pronounced clinically deceased. Detectives discovered that Cherry was engaged in a verbal argument with juveniles, then Kwamiere Durham, 18, of York, was called over by the juveniles and Durham struck Cherry at least once to the head area. This strike caused Cherry to fall to the ground.
