Updated Jan 5

A Mobile man who was recently paroled on a second-degree assault charge was arrested and charged with first-degree rape last week, Mobile police said.

Che’ Marks, 44
, is charged with forcing a woman to have sexual intercourse with him in the early-morning hours of Dec. 28, police said.

About 2:30 p.m. Dec. 28, police responded to a reported rape in the 1300 block of South Ann Street. The victim told police she met Marks at a service station on Saint Stephens Road and exchanged numbers.

She said she later received a text message from Marks telling her to meet at his apartment. Upon arriving there, the victim said Marks assaulted her and pulled her inside. He then forced her to have intercourse, police said.

The victim fled the scene and called police. Officers later found Marks near the area of Interstate 10 and Duval Street. He tried to flee on foot, but was taken into custody.

He was charged with two counts of first-degree rape, second-degree kidnapping, two counts of second-degree assault and attempting to elude, according to court records. He was being held in Mobile County Jail without bond.

Marks was paroled in August 2018 on a second-degree assault charge for which he was sentenced to life in prison.
