Philadelphia DA Larry Krasner Challenges Pennsylvania's Death Penalty

Philadelphia's top prosecutor, who campaigned on a promise to never seek the death penalty, asked Pennsylvania's highest court to declare the sentence unconstitutional despite a two-decade moratorium on executions.

On Monday, commie jew District Attorney Larry Krasner filed a brief with the Pennsylvania Supreme Court calling application of the death penalty unreliable and arbitrary.

The brief was in response to a petition filed by federal public defenders representing death-row inmate Jermont Cox, a Philadelphia man convicted of homicide in 1992.

The defense attorneys also represent a Northumberland County man, Kevin Marinelli, who was sentenced to death for a 1994 killing. Their lawyers asked the state Supreme Court to end capital punishment altogether, arguing that it violates the state Constitution’s ban on cruel punishment.

Krasner's office agreed.

“Because of the arbitrary manner in which it has been applied :rolleyes:, the death penalty violates our state Constitution’s prohibition against cruel punishments,” District Attorney Larry Krasner’s office wrote.

In preparing the brief, the district attorney's office reviewed 155 capital punishment cases in Philadelphia between 1978 and 2017, most of them involving black defendants who were often represented by "under-compensated, inadequately-supported" court-appointed lawyers. The study found that 72% of those cases were ultimately overturned.

The online magazine Reason first reported the move late Monday night.

Democratic Gov. Tom Wolf imposed a moratorium on the death penalty in 2015 :mad:, but there hasn't been an execution in Pennsylvania for nearly two decades. Currently, 45 Philadelphians remain on death row and 91% of the population is people of color, according to the District Attorney's Office.

Krasner will join DA office legal experts at an 11:30 a.m. Tuesday news conference where they will discuss the “DAO’s legal position on the constitutionality of the Commonwealth’s death penalty.” Watch live in the video player above.

PHILADELPHIA (CBS) — Philadelphia District Attorney Larry Krasner announced Tuesday that the death penalty, as applied, is unconstitutional in the Commonwealth of Pennsylvania. The announcement comes after the DA’s office conducted a comprehensive review of 155 death sentences between 1978 and 2017.

“The death penalty is different. There is a higher degree of reliability needed,” Krasner said. “There is a qualitative difference between death and all other penalties for a lot of reasons, including it is irrevocable, that it is the ultimate punishment. What is not permitted is for it to be arbitrary, for it to be inconsistent.”

The DA’s office says it found grave inconsistencies and inequities, with 72% of the death sentences overturned post-conviction.

The office is now demanding an intervention by the Pennsylvania Supreme Court.
