HCSO: Robbers fatally shoot 4-year-old over mom's purse

A little girl is dead and her mother and young sister were critically injured after they were shot during an attempted robbery in north Harris County, according to deputies.

This all started around 8:40pm as a 27-year-old woman was carrying groceries to her apartment alongside her 10-year-old and 4-year-old daughters.

Investigators said at least two men in a dark-colored sedan pulled up next to them and got out. The men reportedly asked for the woman's purse, but she refused. That's when deputies believe one of the men shot the mother and her two children at close range.

Deputies say at least nine shots were fired. The four-year-old girl was struck in the head. The mother was shot in the stomach, but as she was trying to protect her kids, she apparently didn't even realize she'd been hit until a deputy noticed her shirt was bloody.

The youngest of the victims, just 4 years old, was then taken by Life Flight to Memorial Hermann Hospital because of the seriousness of her condition. Sadly, she has died from her injuries.

Her mother and 10-year-old sister were listed in critical condition early this morning, fighting for their lives.

The mother told deputies there were two men, but a witness says there were three. Those suspects are still at large, and their descriptions at this point are extremely vague -- black men, dark colored clothing, dark car. Deputies are reviewing surveillance video in an effort to get a better description.

Suspect in two murders, including a 4-year-old, accused in more violent robberies

One of the men accused in two murders last month is now also alleged to have committed at least two other violent crimes while on the run.

As Phillip Battles, 18, appeared in court, prosecutors detailed two armed robberies in which Battles allegedly took part.

"God was watching out for me," said one of the victims who spoke exclusively with Eyewitness News about the attack in which she was targeted.

She asked us not to use her name as she fears retribution.

She was attacked, she says, in the parking lot of her apartment complex off Wayforest Drive in north Harris County.

"Three young guys jumped out with a gun and ran up to me," she said.

They took her purse and car. She had no way of knowing at the time that one of those allegedly involved was wanted for two murders.

Investigators say 18-year-old Phillip Battles was part of a crew committing a rash of robberies.

First, the murder of 62-year-old Ignacio Ortega, killed Nov. 7. Then, 4-year-old Ava Castillo was shot in the head Nov. 14th as her family was robbed outside their home.

A couple was then attacked Nov. 19th. In that case, investigators say, the woman was shot. Then the victim that spoke to Eyewitness News was targeted on the Nov. 23.

"Oh my God, I'm blessed to be alive, that I did not get killed and hurt," she said.

She is coming to terms with her survival, thinking much about why she would survive and others would not. She's relieved Battles and crew are off the streets for now, but after living in the same apartment complex for 16 years, she concludes it's time to move.
