SHAWNEE, Kan. -- A broad daylight shooting incident at a Wal-Mart in Shawnee on Sunday left one person dead and two others injured. It happened when two bystanders jumped in to help a woman with a baby being attacked by two suspects.

FOX 4's Molly Balkenbush went to the Wal-Mart near Shawnee Mission Parkway and Interstate 435 where the incident occurred.

Police said the woman was loading a baby into a car seat when two men approached her and hit her in the head. That's when a man came to her rescue and things turned deadly.

Police told FOX 4 when the man heard the woman screaming he came to help, but one of the suspects shot him multiple times. That man was later transported to a hospital and is listed in critical condition.

Then a second Good Samaritan reportedly came to the scene and shot one of the suspects, killing him. The second suspect then fled the scene.

Police were able to quickly use surveillance video to arrest that suspect nearby a short time later.

FOX 4 spoke to Janet Lewis, a mother who lives in an apartment complex across the street from the Wal-Mart. She said police came and arrested her son in the parking lot outside her home, accusing him of being one of the suspects.

Police said he matched the description of what they obtained from Wal-Mart surveillance cameras. Lewis said her son is innocent, and was at home when the shooting happened.

"As I come pulling up, I see them arresting my son. I didn't make it to park the car because as I seen my son, and the police around my only child, I sped up," Lewis recalled. "He was a little pissed off. I'm going to put it out there. He was pissed off."

Lewis said the police eventually did take her son into custody as a possible suspect.

Police said the female victim has been upgraded to fair condition. The baby was unharmed.

There is no word yet why the suspects attacked her, or if they knew her. The investigation is ongoing.

The dead attacker, who was shot by a separate Good Samaritan, was identified as 28-year-old John W. Simmons III of Kansas City.

The woman who was attacked Sunday in the parking lot of a Wal-Mart in Shawnee was a 39-year-old Kansas City, Kan., resident. Police said Monday she had been released from the hospital.

The Good Samaritan who was shot when he intervened to help her was a 33-year-old Kansas City man. He had surgery Sunday night and remained in the hospital in serious condition Monday, said Shawnee police spokesman Maj. Dan Tennis.

Police said the woman was attacked about 1:30 p.m. Sunday as she was putting her infant in a car seat after shopping at the store near Shawnee Mission Parkway and Maurer Road. Two people approached and the woman was struck on the head, police said. A Good Samaritan who tried to help her was shot and critically wounded by one of the attackers. At that point the second Good Samaritan, a 36-year-old De Soto man, came forward and shot one of the attackers.

Police said Monday the woman who was assaulted did not know her attackers.

Suspect arrested and charged in Shawnee Wal-Mart shooting

OLATHE, Kan. — Authorities on Tuesday announced an arrest in connection with the Sunday shooting at a Shawnee Wal-Mart.

27-year-old Arthur Fred Wyatt III, of Overland Park, Kan., was arrested on Tuesday and charged in Johnson County District Court with attempted first degree murder, attempted aggravated kidnapping, and attempted aggravated robbery.

Court records allege that Wyatt was one of the men who attacked a 39-year-old Kansas City, Kan. mother in broad daylight in the parking lot of Wal-Mart on Shawnee Mission Parkway off Interstate 435.

During that attack, two Good Samaritans ran to the woman’s rescue, resulting in one Good Samaritan shot and injured, and one suspect, identified as 28-year-old John W. Simmons III of Kansas City, Mo., shot and killed at the scene by another Good Samaritan.

Authorities said they had been searching since Sunday for Wyatt, who fled the scene.

The injured bystander, a 33-year-old Iraq War veteran, is still in the hospital in serious condition.

Wyatt was released from the Kansas Department of Corrections in July after serving a sentence for a 2009 involuntary manslaughter case in Wyandotte County and subsequent violation of probation.

Wyatt is currently being held in the Shawnee jail before being booked in the Johnson County Detention Center.
